GRIEVANCES – ULP’S (active & potential)
- A teacher who was falsely accused of assaulting a student and was exonerated after a police investigation submitted a “false reporting- class A” referral on the offending student. Administration never responded. The Union followed up with an Administration-Union Concern meeting on November 5th where the issue was put to rest.
- Teacher Leaders at the High School whose terms expired last year have been given duties other than “regular teaching assignments” which contradicts the current contract language. A second proposal was presented to the Superintendent to resolve this issue short of a grievance.
- A part-time teacher was given a .6 teaching assignment, but was paid at a .5 rate. We are attempting to resolve at the informal stage of the grievance procedure.
- The Board sub-contracted nursing services at one of our elementary schools. Per Section 39.0, the Union filed a notice to negotiate. The Board informed us that they will not negotiate on this issue. A grievance was filed and heard at Step 2 on October 9th. The grievance was denied at Step 2 and the Union requested a hearing with the Board at Step 3. If the matter is not satisfactorily resolved, a “refusal to bargain” ULP may be filed.
- Special Education teachers at the high school filed a grievance based on teaching/learning conditions at the high school. A productive but inconclusive Step 2 meeting was held on November 4th , and we are awaiting a response.
- New: A grievance on the issue of mandatory outside after school duty assigned to teachers has been filed. The Step 2 hearing is scheduled for Friday, November 13th.
- New: Monticello stewards have filed a grievance because of added instructional and clerical duties assigned due to a new morning intervention period that has been added to the schedule.
ISSUES
- We discovered that a number of members who attended in-service events, including summer retreats, were paid at the $20/hr. rate rather than the $21/hr. rate as required under our new contract. We expect a response from Payroll when a review of all in-service payments is complete.
- Several members have expressed concerns regarding the elementary report cards in terms of the structure of the report card, the window for recording data, and access to Infinite campus at home.
OFT
- The OFT Executive Committee met on November 6th. Agenda items included:
- The governor’s proposal to delay the 2010 state income tax reduction in order to protect education funding in the current budget.
- Proposed amendments to the above including:
i. To use student performance data to evaluate teachers & principals for purposes of licensure. To
ii. allow Teach for America participants to have professional educator licenses.

- The Ohio Retirement Study Commission is reviewing the recommendations from STRS and SERS regarding the solvency and financial future of our pension systems (see October STRS Board Report). The value of STRS investments has increased from $52.6 billion to $58.2 billion for the period of June 30-September 30, 2009.
- OFT will endorse Dale Price for the active teacher seat to be elected in March, 2010. Dale is a members of the Toledo Federation of Teachers (AFT Local #250).
COMMITTEE REPORTS :
5133. The meeting scheduled for October 27 was postponed. We expect it to be rescheduled.
INSURANCE. The district insurance committee met on October 19th and reviewed claim and utilization reports for all of our benefit plans. We also corrected and updated MMO Certificates of Insurance for all of our plans. In addition, the Board is planning to contract with a company to conduct a dependency audit whereby members will need to provide proof of dependent eligibility. This is mandated by state law under the regulations of the School Employees Health Care Board.
